Liability Waiver and Acknowledgment of Risk:
I understand and agree that participating in any dance class, fitness class, performance, or related activity (each, an “Activity”) requires strenuous physical exertion and involves a substantial risk of physical injury, and even death, including but not limited to risks associated with the use of equipment, communicable diseases, and the participation or presence of others during an Activity. I agree that the person participating in an Activity, or, if applicable, that person’s parent and/or legal guardian (collectively, the “Participant”), has the sole obligation to be aware of the Participant’s exertional and/or skill-based limitations (the “Limitations”) at all times and to avoid exceeding those Limitations. I understand and agree that it is the Participant’s sole obligation to: (a) determine the Participant’s limitations, by consulting with a physician, or otherwise, prior to the Participant’s participation in any Activity; and (b) participate in any Activity solely in accordance with the Participant’s Limitations. In consideration for Strut Dance Studio, LLC (the “Studio”) allowing me, my child, and/or any person over whom I have legal guardianship, to be a Participant in any Activity at its premises, I hereby agree to: (a) assume all risks and responsibility for any and all loss, injury, accident or death arising out of or in any way involving any Participant’s participation in any Activity at the Studio’s premises (each, a “Claim”); (b) waive all Claims I otherwise might have; and (c) indemnify and hold the Studio, its members, managers, contractors, and their respective employees, agents, successors and assigns, harmless from and against any loss or damage arising out of or in any way involving any Claim.
I hereby represent and warrant to the Studio that I am the parent and/or legal guardian of any Participant on behalf of whom I am signing this Liability Waiver and Acknowledgement of Risk, and that I have the full authority to do so.
Permission is granted to Strut Dance Studio, LLC to use photographs and videos of students and teachers for publicity purposes.
